Vehicles and contents will be parked and stored entirely at own risk. autoWORKS cannot be held liable for any loss or damage by fire, burglary, theft, accident, or otherwise. No responsibility attaches to autoWORKS to delay due to non-availability of material or other cause whatsoever. Estimates are provisional and not binding. Relevant to the car repairs or car services ordered, repairs will be carried out and new car repair parts will be fitted and supplied as required. Work can be ordered in writing or by verbal agreement. Payments must be made on collection of the vehicle.
The purchaser agrees that s/he shall be liable for all costs or changes incurred by autoWORKS in respect of recovery of any overdue amount owed to autoWORKS or in respect for any proceedings or action brought by autoWORKS which autoWORKS in its sole discretion may consider necessary in order to recover such overdue amounts. S/he furthermore agrees to pay the costs for any proceedings instituted by autoWORK’s attorneys, such as costs to be based on Scale C of the Magistrate's Court Tariff and to include those costs as between attorney and client and any collection charges and any tracing agent's charges reasonably incurred in either ascertaining the purchaser's whereabouts or in collecting any payment due by the purchaser.
WORKS warrants all car repairs to be free from patent defects in material and workmanship for
60,000 kilometres or twelve (12) months
from date of purchase whichever comes first, unless otherwise stated in writing. Normal wear and tear is excluded from this warranty. This warranty does not apply where the product has been deliberately or through gross negligence damaged, altered, misused or tampered by the purchaser or any other unauthorised third party. Accidents caused by the purchaser or any other third party also nullify this warranty. Liability is limited as stated above and consequential damage or incidental losses are not covered. Proof of purchase is required to validate and enforce the warranty.
The purchaser acknowledges that any claim in terms of the warranty is limited in accordance with the terms set out herein. The purchaser further acknowledges that all car repairs are undertaken on the basis that, in the event of any car repair proving to be defective or unsatisfactory for any reason whatsoever, no liability shall attach to the repairer for any loss or damages resulting from such defective car repairs other than the reasonable costs for remedying such defective repairs and then only where it is shown that such defective repairs have arisen as a result of the negligent conduct of the repairer.
- No claim may be made unless the vehicle is delivered to autoWORKS at the customer's cost, or prior authorisation for stripping, replacement or car repair is obtained in writing by the director of autoWORKS.
- The replacement or repair of any defective workmanship, or part, is the entire guarantee given by autoWORKS and no other guarantee is expressed or implied.
- Losses suffered as a result of consequential damage not related to car repairs carried out by autoWORKS or with autoWORKS express written authorisation are not covered by this warranty.
- All warning devices are deemed to be fully functional and working.
- The vehicle has been serviced as recommended by autoWORKS or in accordance with the manufacturer’s specifications and service schedules.
- No claim will be entertained without an invoice/service history, which is to be presented by the complainant on the date of the claim.
- Charges incidental to breakdowns such as towing fees, hotel charges, damage and loss of potential effects and clothing, loss of income, hire of alternative transport and any other incidental or consequential losses do not form part of this warranty and will be at the owner's risk.
- This warranty will only be honoured if the purchaser reports any claim within 7 (seven) days of the nature of the claim becoming known to the purchaser.
The following are examples of exclusions, and will help to avoid misunderstandings:
- Damages caused by improper handling and misuse or due to rallying, racing and time trials
- Normal wear and tear
- Second hand parts and items purchased and supplied by the customer
- Standard car service items over the guarantee period, including oils, gaskets, filters and other miscellaneous materials
- Fair wear and tear on items such as brakes and clutch linings, wiper blades, spark plugs, ignition points and pulley belts
- Light bulbs and fuses and all electrical components
- Wheel balancing and alignment or other mechanical adjustments over the service guarantee period
In the event of a dispute regarding the car service center, WORKS will be willing to abide by a decision reached by the RMI acting as the arbitrator.
